SAN ANTONIO, Texas -- A man shot in the shoulder by an officer last month in a Northwest Side convenience store was alternately pointing a gun at officers and his own head, according to police documents released Monday.
Police were initially called just after 6 p.m. on Dec. 21 to the 5200 block of Meadow Field, where Jesus Chuy Garcia, 36, was reportedly walking up and down the block brandishing a gun, the police report states.
Officers took cover behind their cars when they saw Garcia pointing a silver handgun to the bottom of his chin, and ordered him to drop the gun, police said. But he put the gun to his head or in his mouth -- and twice pointed it at them -- as he walked back and forth, sometimes toward them, sometimes retreating and sometimes dropping to his knees, the report states.
Garcia eventually sprinted down the street and entered the convenience store in the 8800 block of Grissom Road, still pointing a gun at his head and mouth, according to police.
Sgt. Barry Smith stood in the doorway and tried to convince Garcia to put the gun down but Garcia pointed his gun at Smith and the officers standing outside the store, causing another sergeant to shoot a bean bag at Garcia, which "didn't really have any effect," the report states.
At that point, Officer Matthew Robles shot Garcia through the window, fearing for Smith's life, the report said. Police handcuffed Garcia and a tactical medic treated him until emergency medical technicians arrived.
Garcia was shot in the shoulder, police said at the time. He was taken to University Hospital, where he was booked by proxy on a charge of aggravated assault with a deadly weapon.
