Global Traffic Technologies Granted Federal Injunction Against Emtrac GPS-Based Traffic Priority Control System
Minneapolis, MN – November 13th, 2013 -- As a follow-on to the successful jury verdict in September 2013 against defendants Rodney “Kris” Morgan, KM Enterprises, Inc., and STC, Inc. (collectively, “Emtrac”)—the individual and entities responsible for the Emtrac GPS System—the U.S. Federal Court has now granted an injunction against Emtrac.
The injunction prohibits Emtrac from manufacturing, selling, offering for sale, using, or importing the Emtrac GPS System with respect to new customers. The injunction also prohibits Emtrac from manufacturing, selling, offering for sale, using, or distributing software, hardware, and/or instructions (whether in person or through manuals, advertisements, websites, or otherwise), for the purpose of programming or enabling or facilitating the use of the Emtrac GPS System with respect to new customers.
The injunction does allow Emtrac to maintain the Emtrac GPS System for existing customers, but it prohibits expansion of existing systems to additional vehicles or intersections. The injunction also allows Emtrac to manufacture, sell, offer to sell, use, or distribute software, hardware, and/or instructions for the purpose of programming or enabling the use of existing Emtrac GPS Systems. Please note that this injunction expires on January 7, 2014, which is when the patent expires as well.
